| dc.description.abstract | No presente trabalho abordam-se questões relacionadas com a Gestão do Local do Crime, no âmbito da Investigação Criminal, mas que também tocam autonomia técnica e táctica da Polícia da República de Moçambique1, quando em funções de auxiliar da administração da justiça, e ainda no relacionamento com os demais órgãos intervenientes no local do crime, com particular destaque para o Ministério Público. Analisa-se o domínio material da investigação da criminalidade dita de cenário, nas suas diferentes formas e a coadjuvação prestada pelo Ministério do Interior, ao Ministério Público, através da Polícia de Investigação Criminal (PIC) no Comando-Geral da PRM (CGPRM). Ajuíza-se sobre o grau da intervenção e os limites da actuação prestada por cada órgão interveniente no local do crime, com objectivos de praticarem os actos necessários às finalidades Processuais Penais2. Aborda-se a relação funcional entre a Polícia de Protecção e a PIC, quanto à questão dos procedimentos da preservação dos meios da prova no local do crime, bem como a sua recolha. Por fim, fala-se de possíveis soluções susceptíveis de dirimir a conflitualidade existente neste precioso trabalho, contribuindo deste modo para a optimização das boas práticas que devem imperar na gestão do local do crime, no sistema de investigação criminal ao bem da aplicação da justiça. | pt_PT |
| dc.description.abstract | The present work deals with issues related to the Local Management of crime scene in the scope of criminal Investigation, but also to technical and tactical autonomy of police of the Republic of Mozambique, where the helper functions in the administration of justice, and the relationship with other services involved in the crime scene, with particular reference to the Public prosecutor. It analyzes the material realm of actual investigation of crime scene, in its different forms and assistance rendered by the Ministry of interior, the public prosecutor office, through the criminal investigation police (PIC) in the General Command of the Mozambique Police (CGPRM). It judges the degree of intervention and the limits of performance provided by each organ that work on the scene of crime, with the goal of committing the procedures necessary to the purposes of criminal procedure. It addresses the functional relation between the protection police and PIC in the question of procedures to preserve evidence at the crime scene, as well gathering further evidence. Finally, it takes possible solutions that could resolve the existing conflicts in this precious work, thereby contributing to the optimization of best practices that should prevail in the management of crime scenes, the criminal investigation system and application of justice | pt_PT |
