Com a nomeação de Barack Obama para a presidência dos Estados Unidos da
América, o tema dos direitos humanos voltou a estar na agenda interna e internacional.
O objectivo deste breve estudo é analisar se estaremos perante uma nova era da
política americana relativamente aos direitos humanos, numa clara ruptura com o passado.
Inicialmente, será referenciado o Tribunal Penal Internacional e a Convenção
contra a Tortura e outros Tratamentos ou Penas Cruéis, Desumanos ou Degradantes como
enquadramento sobre os direitos humanos.
Será analisada a administração Bush, nomeadamente a particularidade da prisão
militar de Guantánamo e Abu Ghraib, os erros cometidos, as injustiças praticadas e as
ilegalidades cometidas.
Rápido a cumprir promessas e no sentido de restaurar a imagem do país no exterior,
Barack Obama suspendeu os processos judiciais em curso contra os prisioneiros detidos
em Guantánamo, iniciou o processo para fechar a prisão até inicio de 2010 e proibiu a
utilização da tortura nos interrogatórios.
No entanto, Obama terá de demonstrar de forma mais profunda a sua política,
nomeadamente, o reconhecimento do TPI e iniciar processos judiciais para julgar os
culpados das ilegalidades, atrocidades e injustiças cometidas no passado recente. Abstract: With the nomination of Barack Obama for the presidency of the United States, the
issue of human rights once again is in the domestic and international agenda.
The purpose of this Study is examining whether it will be a new era of American
policy on human rights, a clear break with the past.
Initially, it will be referenced in the International Criminal Court and the
Convention against Torture and other Treatment or Cruel, Inhuman or Degrading as a
framework on human rights.
Analyzes the Bush administration will be made, including the peculiarity of the
Guantanamo and Abu Ghraib military prisons, the mistakes, the injustices and illegalities
performed.
Quick and to fulfill promises to restore the country's image abroad, Barack Obama
suspended the proceedings under way against detainees held at Guantánamo Bay, has
started the process to close the prison until early 2010 and prohibited the use of torture in
interrogations .
However, Obama will have to evidence a more profound its policy, namely,
recognition of the International Criminal Court and start proceedings to prosecute those
guilty of unlawful acts, atrocities and injustices committed in the recent past.
