Policiamento de espetáculos desportivos das camadas jovens: da excecionalidade ao Over-Policing

| dc.description.abstract | Com a presente investigação, procurámos demonstrar que a lei reserva medidas distintas para a prevenção e repressão da violência associada ao desporto, consoante se trate de competições profissionais ou não profissionais. Verificámos que, no quadro destes palcos competitivos, desenvolveram-se dois padrões distintos de violência, mormente no futebol, para os quais a lei apresenta soluções diferentes. Percorrendo o regime jurídico de policiamento de espetáculos desportivos, concluímos que o legislador institui a regra da dispensa de policiamento, excetuando a sua obrigatoriedade para os espetáculos desportivos integrados em competições de natureza profissional. Concluímos, também, que, para as competições de escalões juvenis e inferiores (camadas jovens), a lei é ainda mais restrita, estabelecendo que a presença da autoridade policial deve ocorrer excecionalmente e de forma justificada. Na sequência de um episódio sui generis, que opôs um comando metropolitano da Polícia de Segurança Pública e o Ministério da Administração Interna, foi tornado público que aquela regra legal não é respeitada, mormente no futebol de formação. Continua a verificar-se que os promotores de espetáculos teimam em recorrer ao policiamento para morigerar o comportamento dos espetadores e agentes desportivos, descuidando os efeitos nefastos que o over-policing aporta a longo prazo. | pt_PT |
| dc.description.abstract | With this research, we have tried to demonstrate that the law reserves different measures for the prevention and repression of sports-related violence, depending on whether they are professional or non-professional competitions. We have seen that, in the context of these competitive stages, two distinct patterns of violence have developed, especially in football, to which the law offers different solutions. Analyzing the legal regime of policing sporting events, we conclude that the legislator establishes the rule of exemption from policing, except for its obligation for sporting events integrated in professional competitions. We also conclude that, for competitions of youth and lower echelons, the law is even more restricted, establishing that the presence of the police authority must occur exceptionally and in a justified manner. Due to a sui generis episode, which opposed a metropolitan department of the Public Security Police and the Ministry of Internal Affairs, it was made public that this legal rule is not respected, especially in youth soccer. The clubs continue to insist on using policing to moderate the behavior of spectators and sports agents, neglecting the harmful effects that over-policing brings in the long term. | pt_PT |
