Os guardas prisionais representam os elementos mais próximos dos
reclusos, uma vez que são as pessoas que passam mais tempo com os mesmos.
As finalidades da pena passam pela proteção de bens jurídicos e reintegração
do agente na sociedade (art. 40.º do Código Penal), logo, é da maior importância
investigar se os guardas acreditam que a prisão pode ocasionar mudanças nos
reclusos de modo a se integrarem na sociedade após o cumprimento da pena,
sem reincidirem.
A presente dissertação teve como objetivo analisar as perceções de
guardas prisionais no ativo, em convivência assídua e regular com reclusos, em
relação à sua reinserção na sociedade. Para cumprir esta finalidade, foram
analisados os dados de um questionário online aplicado a uma amostra de 121
guardas prisionais, com idades compreendidas entre os 26 e os 63 anos (M =
32.8), incluindo 102 participantes do género masculino e 19 do género feminino,
todos de nacionalidade portuguesa.
Com a análise de resultados, constatou-se que a maioria dos participantes
não acreditam na reintegração social dos reclusos por haver falta de meios para
a colmatar, nomeadamente, falta de acompanhamento depois de cumprida a
pena, penas demasiado leves e falta de formação ou ocupação laboral que na
opinião de muitos deveria ser obrigatória. Conclui-se assim, que ainda há um
longo caminho a percorrer no que concerne à reintegração dos reclusos na
sociedade.
Prison officers represent the closest elements to the inmates, as they are the people who spend the most time with them. The purpose of the penalty is the protection of legal assets and reintegration of the offender into society (art. 40.º Penal Code), so it is of the utmost importance to investigate if the guards believe that prison can bring changes in inmates to integrate them into society after the sentence has been served, without reoffending. This dissertation aimed to analyze the perceptions of active prison guards, in regular contact with inmates, in relation to their reintegration into society. To achieve this, analyzed data was aquired from an online questionnaire applied to a sample of 121 prison guards, aged between 26 and 63 years old (M = 32.8), including 102 male participants and 19 female participants, were analyzed, all of the participants being Portuguese. With the analysis of results, it was found that the majority of participants do not believe in the social reintegration of prisoners because of an existing lack of means to achieve this, namely, lack of follow-up after the sentence has been served, sentences that are too light and lack of training or occupation, which in the opinion of many should be mandatory. It is therefore concluded that there is still a long way to go regarding the reintegration of prisoners into society.
