Abstract(s)
A intervenção do sistema judicial e do sistema policial junto dos menores, por si só,
releva especial sensibilidade e acuidade, atendendo, em concreto, à fase de formação da
personalidade. Os menores de 16 e 17 anos, no sistema jurídico português, encontram-se
sob a tutela da jurisdição penal.
Atendendo a que, nos últimos 10 anos, foram detidos na área da Polícia de Segurança
Pública, 10.779 menores, de 16 e 17 anos, pela prática de crimes, pretendemos, com este
estudo perceber se o regime jurídico português e o sistema policial salvaguardam as
especificidades de um menor de 18 anos, detido pela prática de um crime.
Para tal, foram entrevistadas quatro personalidades, com experiência comprovada na
área da justiça, policial, da promoção e proteção de crianças e jovens e psicologia
comportamental, respetivamente, concluindo-se que os normativos legais que regulam este
fenómeno estão desatualizados, tendo em consideração a evolução das dinâmicas sociais e
vivenciais dos menores. Todos os entrevistados reportaram problemas emergentes no
tratamento destes jovens, reconhecendo que, futuramente, algo terá que mudar na
condução deste processo. Sugere-se então uma reflexão mais aprofundada, com vista à
melhoria das intervenções policiais sobre estes sujeitos, bem como a sensibilização do
poder político para a revisão dos diplomas que regulam esta matéria.
The intervention of the judicial system and the police system in relation to minors, by itself, reveal special sensitivity and acuity, taking into account, in particular, the personality formation stage. Minors under 16 and 17 years of age, in the Portuguese legal system, are under the tutelage of criminal jurisdiction. Considering that, in the last 10 years, 10,779 minors, aged 16 and 17, were arrested by Public Security Police for committing crimes, we intend, with this study, to understand whether the Portuguese legal and the police systems safeguard the specificities of a minor of 18 years of age, arrested for committing a crime. To this end, four personalities were interviewed, with proven experience in the area of justice, police, educational protection and behavioural psychology, respectively, concluding that the legal norms that regulate this phenomenon are outdated, taking into account the evolution of social and experiential dynamics of minors. All interviewees reported emerging problems in the treatment of these young people, acknowledging that, in the future, something will have to change in the conduct of this process. It is therefore suggested that there should be more in-depth reflection, with a view to improving police interventions on these subjects, as well as raising the awareness of the political power for the revision of the diplomas that regulate this matter.
