Abstract(s)
Os crimes ambientais produzem efeitos irreversíveis e, neste contexto, o presente trabalho procura perceber como as ações desenvolvidas pela investigação criminal ambiental da Guarda Nacional Republicana podem contribuir para este desiderato ao nível do espaço europeu.
Para o efeito foram detalhadas as forças da Guardia Civil do Reino de Espanha, Gendarmerie Nationale da República Francesa, a Arma dei Carabinieri da República Italiana e a Guarda Nacional Republicana da República Portuguesa.
Perante um crime volátil e sem fronteiras, a experiência dos investigadores revelou-se um pilar determinante quer pelo desenvolvimento das suas capacidades técnicas, quer pela experiência acumulada, derivada do seu desenvolvimento pessoal e a obtida pela partilha das informações. Assim, a criação de um curso de investigação criminal ambiental e a evolução da partilha de informação e cooperação com as forças congéneres tornam-se as linhas dos principais caminhos a trilhar.
A revisão do enquadramento legal assume particular relevância na investigação de uma tipologia criminal em permanente mutação, cada vez mais transnacional e mais correlacionada com outros tipos de criminalidades.
Concluímos que a GNR tem uma estrutura adequada à missão, podendo ser aprimorada com a criação de uma unidade de investigação criminal ambiental de âmbito nacional para casos de relevante complexidade.
Environmental crimes produce irreversible effects and, in this context, the present work seeks to understand how the actions developed by the environmental criminal investigation of the National Republican Guard can contribute to this aspire in the European space. The forces of the Guardia Civil of the Kingdom of Spain, the Gendarmerie Nationale of the French Republic, the Arma dei Carabinieri of the Italian Republic and the Republican National Guard of the Portuguese Republic were detailed. Faced with a volatile and borderless crime, the experience of researchers has proved to be a pillar of both the development of their technical skills and the accumulated experience of their personal development and that of sharing information. Thus, the creation of an environmental criminal investigation course and the evolution of information sharing and cooperation with counterparts become the main paths to be followed. The revision of the legal framework assumes particular relevance in the investigation of a criminal typology in permanent mutation, increasingly transnational and more correlated with other types of criminality. We conclude that GNR has a structure adequate to the mission, and can be improved with the creation of a national criminal investigation unit of national scope for cases of relevant complexity.
