Abstract(s)
O lar representa o espaço mais íntimo da pessoa: é o albergue, o asilo, último
reduto da liberdade. A ingerência do Estado nesse porto de refúgio deve ser alvo das
maiores restrições; por isso as buscas a esses locais sempre mereceram um regime de
excepção em todos os ordenamentos jurídicos.
A inviolabilidade do domicílio é um dos direitos fundamentais consagrados na
Constituição da República Portuguesa. A extensão das garantias desse direito foi
drasticamente reduzida em 2001, em prejuízo de um pretenso incremento da eficácia da
justiça relativamente à criminalidade mais grave. Neste âmbito, os órgãos de polícia
criminal e o Ministério Público viram as competências próprias largamente dilatadas e o
período da noite deixou de ser um direito absoluto.
A Lei n.º 48/2007, de 29 de Agosto, veio dar expressão aos novos contornos
definidos pela lei constitucional, alterando a redacção do art. 177.º do Código de Processo
Penal. Afigura-se, por este motivo, pertinente o estudo e análise do novo regime das buscas
domiciliárias e das novas competências das polícias nesta matéria.
The home represents the most intimate space of the person: is the hostel for asylum, the last redoubt of freedom. The State interference in this anchor should be as restricted as possible; therefore the searches at these places always deserved a special regimen in all jurisdictions. The inviolability of the domicile is one of the fundamental rights enshrined in the Constitution of the Portuguese Republic. The extent of the guarantees of this right has been drastically reduced in 2001, to the detriment of an alleged increase in the efficiency of justice in relation to more serious crime. In this context, the criminal police and prosecutors viewed its own powers widely dilated and the period of the night is no longer an absolute right. Law No. 48/2007, dated 29 August, gives expression to the new contours defined by constitutional law, changing the wording of art. 177. of the Code of Criminal Procedure. It is, therefore, relevant to study and analyze the new system of house searches and new powers of the police in this matter.
