O presente trabalho procura argumentar a defesa do recurso ao método do agente infiltrado por parte da Polícia de Segurança Pública. Procuramos demonstrar que o recurso a este meio de investigação no âmbito da PSP pode ser legítimo, iure constituendo, se tivermos em consideração que existem crimes que se enquadram no recurso ao agente infiltrado que podem ser delegados na PSP e que o modo como a actual evolução da criminalidade ameaça e coloca em causa de forma permanente os mecanismos de investigação do Estado e a própria a administração da justiça.
Face a uma criminalidade que manifesta uma complexidade crescente procuramos afirmar a utilização do agente infiltrado como um meio importante de investigação da conduta criminosa, se bem que, para isso, tenha que recorrer a técnicas de obtenção de prova que actuam no limite dos direitos, liberdades e garantias fundamentais do cidadão.
This paper tries to argue in defense of using the method of the undercover agent by the Polícia de Segurança Pública. We demonstrate that using this means of investigation under the PSP may be legitimate, iure constituendo, if we take into account that there are crimes that fall in the use of undercover agent that can be delegated to the PSP and how the current developments threat of crime and questions of permanent mechanisms for investigation of the State and the administration of justice. Faced with a crime that manifests an increasingly complex endeavor to assert the use of the undercover agent as an important means of investigation of criminal conduct the criminal intent, though, for this, have to resource to techniques of obtaining evidence that they act within the limits of rights, freedoms and guarantees of citizen.
