- A NATO e os Direitos Humanos – O princípio da responsabilidade de proteger como propósito para a intervenção militarPublication . Bailote, RicardoO presente estudo visa analisar a aplicabilidade do princípio da Responsabilidade de Proteger, enquanto garante dos Direitos Humanos e propósito para uma intervenção militar. Através de uma metodologia de investigação qualitativa, por via do método dedutivo, recorreu-se à recolha documental clássica e respetiva realização de entrevistas. Efetuou-se um enquadramento conceptual sustentado, com particular enfoque nas definições do uso da Força, Direitos Humanos e a Responsabilidade de Proteger. Procedeu-se à análise das dinâmicas inerentes ao uso da força, em contexto internacional, bem como das situações de ingerência humanitária a montante de 2005, com particular destaque para as intervenções com propósitos humanitários, ocorridas após o final da guerra fria, durante a década de noventa. Analisou-se a implementação e evolução da Responsabilidade de Proteger enquanto norma conciliadora entre os Direitos Humanos e o princípio da Não Ingerência, nas suas dimensões, pilares estruturantes e critérios para o uso da força com propósitos humanitários. Destarte, analisou-se a intervenção na Líbia da Organização do Tratado do Atlântico Norte, em 2011, ao abrigo da Responsabilidade de Proteger, mormente em termos do impacto negativo e respetivas consequências que a ação armada exaltou no país em conflito e, inclusive, no próprio princípio com evidentes repercussões na sua aplicação em situações vindouras. Abstract: This research study aims to analyse the applicability of the principle responsibility to protect as a guarantor of human rights and a purpose for military intervention. Through a qualitative research strategy, by means of the deductive method, standard documental review and interviews. In this context, a supported conceptual framework was carried out, with particular focus on the definitions such as the use of Force, Human Rights and the responsibility to protect. An analysis was carried out of the dynamics inherent to the use of force in an international context and of the situations of humanitarian interference prior to 2005, with particular emphasis on interventions with humanitarian purposes that took place after the end of the Cold War, during the 1990s. The implementation and evolution of the responsibility to protect was analysed, as a reconciliatory approach between human rights and the principle of non-interference, its dimensions, its structuring pillars and criteria for the use of force with humanitarian purposes. Therefore, the intervention of the North Atlantic Treaty Organisation in Libya in 2011, under the responsibility to protect, was assessed, considering the impact and consequences that the armed action raised in the country in conflict and in the principle itself, with obvious repercussions on its application in future situations.
