O Estado Português é uma República soberana, baseada na dignidade da pessoa humana, que na prossecução das suas funções essenciais de Segurança, Justiça e BemEstar dos cidadãos, atribuí como especiais funções às polícias, nomeadamente à Guarda Nacional Republicana, a defesa da legalidade democrática, a garantia da segurança interna e a defesa dos direitos dos cidadãos. As FSS norteiam a sua atuação em conformidade com os princípios consagrados na Constituição e na Lei. É da competência das FSS garantir a ordem e a tranquilidade públicas, a segurança e a proteção das pessoas e dos bens, prevenindo a prática dos atos contrários à lei e regulamentos. A Guarda Nacional Republicana, é uma força de segurança de natureza militar tal como preconizado no artigo 3º da respetiva lei orgânica (Lei n.º 67/2007 de 6 de Novembro). As suas atribuições são: garantir as condições de segurança que permitam o exercício dos direitos e liberdades e o respeito pelas garantias dos cidadãos, garantir o pleno funcionamento das instituições democráticas, o respeito pela legalidade e pelos princípios do Estado de direito. Os Direitos Fundamentais, tais como os entendemos hoje, são verdadeiros direitos ou liberdades, reconhecidos em geral aos homens ou a certas categorias de entre eles, por razões de "humanidade". São nessa medida, direitos de igualdade, universais, e não são direitos de desigualdade, estamentais. Há um conjunto de Direitos Fundamentais, do qual decorrem todos os outros: o conjunto dos direitos que estão mais intimamente ligados à dignidade e ao valor da pessoa humana e sem os quais os indivíduos perdem a sua qualidade de homens. Quanto aos Direitos Fundamentais de reunião e manifestação, beneficiam de um âmbito de tutela constitucional, decorrente do regime comum aos Direitos Fundamentais, e do regime de proteção específico dos direitos liberdades e garantias, constantes no catálogo dos Direitos Fundamentais da CRP, artigo 45º e são regulados pelo Decreto-Lei n.º 406/74 de 29 de agosto. Na sequência das revindicações dos camionistas, estes têm realizado reuniões e manifestações nas faixas de rodagem, procurando desta forma alcançar determinados objetivos por eles consignados. No entanto, estas ações, conhecidas por "bloqueios",suscitam algumas questões relativamente à sua legalidade e quanto à abrangência e correspondente proteção, pelo regime jurídico tutelador dos Direitos Fundamentais de reunião e manifestação. A inexistência de um conceito de bloqueio no âmbito dos Direitos Fundamentais de Reunião e Manifestação, origina a necessidade de apurar e distinguir as reuniões e manifestações efetuadas com recurso ao bloqueio, das demais. Um aspecto caraterizador do citado é a existência de um obstáculo à livre circulação dos demais cidadãos, não intervenientes na ação.Abstract This study seeks to understand to what extent the actions of Guarda Nacional Republicana (GNR), stopping the blockade of truckers are whether or not repressing the fundamental rights of assembly and demonstration. The Portuguese State is a sovereign Republic, based on human dignity, that in the pursuit of its core functions of security, justice and welfare of citizens, as attributed special functions to the police, including the GNR, the defense of legality democratic, the safeguarding of internal security and defending the rights of citizens. Forces and Security Services guide its activities in accordance with the principles embodied in the Constitution and the Law. It is the responsibility of the Forces and Security Services to ensure public order and tranquility, security and protection of persons and property, preventing the practice of acts contrary the law and regulations The GNR is a security force of a military nature as envisaged in Article 3 of the relevant technical Organic Law (Law n.º 67/2007 of 6 November). Its tasks are to ensure the security conditions that allow the exercise of rights and freedoms and the respect of guarantees of citizens, ensuring the full functioning of all democratic institutions, respect for legality and the rule of law. Fundamental rights, such as we understand them today, are real rights or freedoms recognized in general to men or to certain categories of them, for reasons of "humanity." They are to that extent, equal rights, universal rights and are not of inequality. There is a set of Fundamental Rights, which all others arise: the set of rights that are more closely linked to the dignity and worth of human person, and without which individuals lose their status as men. As for the fundamental rights of assembly and demonstration, benefiting from a framework of constitutional protection as a result of the common system of the Fundamental Rights, and the system of specific protection of the rights, freedoms and guarantees contained in the catalog of Fundamental Rights of the Portuguese constitution, Article 45º and are regulated by Decree-Law n.º 406/74 of August 29. As a result, of truckers' complaints, they had made meetings and demonstrations in the lanes, attempting to achieve certain goals set out for them. However, these actions, known as ―blockade", raise some questions regarding its legality, completeness and protection by the legal regime of fundamental rights of assembly and demonstration. The lack of a blockade concept under the Fundamental Rights of Assembly and Demonstration, generates the need to determine and distinguish the meetings and demonstrations carried out using the "blockade" of the others.
