Teve como propósito a análise da base do regime jurídico português sobre a prevenção e controlo da poluição sonora, à luz das recomendações e diretivas da Organização Mundial de Saúde e da União Europeia. A poluição sonora é a segunda principal forma de poluição do ar e representa graves riscos para os ecossistemas e para a saúde humana, que se traduzem na perda de milhares de vidas por ano, motivo pelo qual é fundamental garantir a eficácia da sua prevenção e controlo. O seu regime jurídico é extenso e complexo, mas a análise dos seus diplomas estruturantes permitiu-nos concluir que não é adequado à efetiva salvaguarda do direito à saúde e bem-estar, motivo pelo qual deve ser alvo de uma reflexão e discussão alargadas. Concluímos ainda que o contributo que as novas tecnologias podem oferecer nesta matéria deve ser mais explorado.This study was motivated by the high number of requests for support, addressed to the Public Security Police, based on the nuisance caused by noise, which led us to think that something could possibly be improved in terms of prevention. Its purpose was to analyze the basis of the portuguese legal regime on noise pollution prevention and control, in the light of the recommendations and directives of the World Health Organization and the European Union. Noise pollution is the second main form of air pollution and poses serious risks to ecosystems and human health, resulting in the loss of thousands of lives per year, which is why it is essential to ensure the effectiveness of its prevention and control. Its legal regime is extensive and complex, but the analysis of its structuring regulations allowed us to conclude that it is not adequate to the effective safeguard of the right to health and well-being, which is why it should be the object of a broad reflection and discussion.
